Kanjoya is committed to protecting the privacy of your information. This Privacy Policy applies to www.kanjoya.com and our service platform owned and operated by Kanjoya, Inc. “Kanjoya”. This privacy policy describes how Kanjoya collects and uses the personal information you provide on our website and our service platform: www.kanjoya.com (each a “Kanjoya Site”). It also describes the choices available to you regarding our use of your personal information and how you can access and update this information. By voluntarily using a Kanjoya Site and/or providing data or other information via a Kanjoya Site, you are indicating your consent to this Privacy Policy and agree to be bound by its terms.

Kanjoya participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework. Kanjoya is committed to subjecting all personal data received from European Union (EU) member countries, in reliance on the Privacy Shield Framework, to the Framework’s applicable Principles. Kanjoya is responsible for the processing of personal data it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. Kanjoya complies with the Privacy Shield Principles for all onward transfers of personal data from the EU, including the onward transfer liability provisions.

 

With respect to personal data received or transferred pursuant to the Privacy Shield Framework, Kanjoya is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, Kanjoya may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Under certain conditions, more fully described on the Privacy Shield website, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.

 

Kanjoya, Inc. has further committed to cooperate with EU data protection authorities (DPAs) with regard to unresolved Privacy Shield complaints concerning human resources data transferred from the EU in the context of the employee data that it processes in its role as a service provider.

Personal Information

You can visit a Kanjoya Site without telling us who you are and without revealing any information about yourself. There are times, however, when we may need certain Personal Information from you.

 

You may choose to provide us with Personal Information (such as your name, email address, phone number and company name) through a Kanjoya Site when you elect to register with Kanjoya in order to download or access our products or services. When you provide Personal Information in order to register with Kanjoya, such Personal Information will be used in order to provide you with access to the requested products, services content and/or information. We may also use the Personal Information to help us understand who is using our products and services and to help us manage business development activities. Kanjoya may also use Personal Information for marketing purposes. For example, Kanjoya may use information you provide to contact you to further discuss your interest in our products or services and to send you information regarding Kanjoya and its partners, such as information about promotions or events. If you tell us that you do not want us to use this Personal Information as a basis for further contact with you, we will respect your wishes.

Information Related to Data Collected for our Client

Kanjoya collects information under the direction of its various customers “Clients”, and has no direct relationship with the individuals whose Personal Information it processes. If you are a customer of one of our Clients and would no longer like to be contacted by one of our Clients that use our service, please contact the Client that you interact with directly. We may transfer Personal Information to companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our Clients.

 
Access and Retention of Data Controlled by our Clients

Kanjoya has no direct relationship with the individuals whose Personal Information it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his query to Kanjoya’s Client (the data controller). If requested to remove data we will respond within 30 days.

 

We will retain Personal Information we process on behalf of our Clients for as long as needed to provide services to our Client. Kanjoya will retain this Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

 
Statistical Information

In addition, we sometimes collect anonymous information from visits to a Kanjoya Site to help us provide better customer service and to make a Kanjoya Site as user friendly as possible. For example, we keep track of the domains from which people visit and we also measure visitor activity on a Kanjoya Site. However, when we do so, we do so in ways that keep the information anonymous. Kanjoya may use this data to analyze trends and statistics. None of the information described in this paragraph is reviewed at an individual level.

Kanjoya and its partners use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole. Blogs/Forums/Chat Rooms/Bulletin Boards

If you use a blog, forum, chat room or bulletin board on a Kanjoya Site (“Forum(s)”), you should be aware that any Personal Information you submit in a Forum can be read, collected, or used by other users of such Forums, and could be used to send you unsolicited messages. We are not responsible for the Personal Information you choose to submit in a Forum. To request removal of your Personal Information from our blog, contact us at [email protected] In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

 
Customer Testimonials

Kanjoya may post customer testimonials on a Kanjoya Site, which may contain Personal Information such as customer’s name. We obtain the customer’s consent prior to posting their testimonial. If you wish to update or delete your testimonial, you can contact us at [email protected].

 
Social Media Widgets

Our website includes Social Media Features, such as the Facebook button and Widgets, such as the Share this button or interactive mini-programs that run on our site. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our website. Your interactions with these Features are governed by the privacy policy of the company providing it.

 
Invite Users

If you choose to invite individuals to our service platform, we will ask you for their email address. We will automatically send them an email inviting them to visit the site. Kanjoya stores this information for the sole purpose of sending these invitation emails and tracking the number of users who accepted the invitation.

You can import contacts or import data through the use of Kanjoya’s analytics platform, Perception, by uploading a CSV or an excel file containing applicable internal data to be analyzed.. Kanjoya collects this information solely statements of work with each customer.

Kanjoya is not in the business of selling your Personal Information. We consider this information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your Personal Information with certain third parties without further notice to you, as set forth below:

 

  • Business Transfers: As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Information may be part of the transferred assets.   • Job Application: We use a third party service provider to host our job applications. The company is authorized to use the Personal Information you provide only as necessary to provide their services to Kanjoya. The vendor upholds their own data protection standards and is TRUSTe Certified.
  • Agents, Consultants and Related Third Parties: Kanjoya, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples of such functions include mailing information, maintaining databases and processing payments. When we employ another company to perform a function of this nature, we only provide them with the information that they need to perform their specific function.
  • Legal Requirements: In certain situations, Kanjoya may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforment requirements.

 

Kanjoya may disclose your Personal Information if required to do so by law such as to comply with a subpoena, or similar legal process or in the good faith belief that such action is necessary to (i) comply with a legal obligation, investigate fraud, or respond to a government request (ii) protect and defend the rights or property of Kanjoya, (iii) act in urgent circumstances to protect the personal safety of users of a Kanjoya Site or the public, or (iv) protect against legal liability.

 
Joint Offerings

From time to time, Kanjoya may partner with other companies to jointly offer products or services. If you purchase or specifically express interest in a jointly-offered product or service from us, Kanjoya may share information collected in connection with your purchase or expression of interest with our joint promotion partner(s). Kanjoya does not control our business partners’ use of the information we share with them, and their use of the information will be in accordance with their own privacy policies. International Transfer of Information Collected

To facilitate Kanjoya’s global operations, Kanjoya may transfer and access information regarding Kanjoya customers from around the world, including the United States. This Privacy Policy shall apply even if Kanjoya transfers information regarding Kanjoya customers to other countries.

 
Customer Data

Kanjoya customers may electronically submit data or information to the Kanjoya platform for hosting and processing purposes (“Customer Data”). Kanjoya will not review, share, distribute, or reference any such Customer Data except as provided in the Kanjoya Terms of Use, or as may be required by law. In accordance with the Kanjoya Terms of Use, Kanjoya may access Customer Data only for the purpose of providing the Kanjoya services, preventing or addressing service or technical problems, at a Kanjoya customer’s request in connection with customer support matters, or as may be required by law.

 
Security

Personal Information collected through a Kanjoya Site is kept in a secure database and all reasonable precautions are taken to secure this data. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from a Kanjoya Site may not be secure. Therefore, you should take special care in deciding what information you send to Kanjoya via e-mail. Please keep this in mind when disclosing any Personal Information to Kanjoya via the Internet. The security of your Personal Information is important to us. When you enter sensitive information on our registration pages or order forms and when you enter your login credentials, we encrypt that information using secure socket layer technology (SSL).

We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
